DUI with a 0.17 preliminary test - Not Guilty
Why try a DUI? This is why. from Mundelein, ILMundelein is a town in Lake county, Illinois just filled with curvy streets, and the police know it - "improper lane usage" is easy as pie to spot and often leads to a DUI arrest. MC was stopped for just that offense, and things went downhill from there. Although here speech was clear and she held up her end of conversation well, the officer smelled alcohol. MC, like most people, thought she'd better not lie to the police and told them she had about 2 beers. That was the kiss of death - most officers in Illinois think if you say "2 beers" you drank a keg. After exiting the vehicle and performing a number of tests, the officer decided MC failed, but just barely. MC took a PBT or preliminary breath test, resulting in a 0.17 result. That just didn't make sense - MC didn't look or act like a 0.17 should, but the officer arrested her anyway. MC stood strong and took the case to trial at the Waukegan, Illinois court, and was found not guilty.
